Recently, the Brazilian National Data Protection Authority (“ANPD” or “Brazilian DPA”) upheld the preventive measure applied against the company Tools for Humanity – TFH, suspending the offer of financial incentives for iris collection.
After the initial suspension, which we analyzed in this newsletter, TFH filed an administrative appeal, which was rejected by the ANPD’s Board of Directors. In the Brazilian DPA’s view, the motives that led to the suspension remained unchanged.
Additionally, the ANPD rejected the request for an additional 45-day period to comply with the measure, maintaining the requirement for immediate compliance.
