Antitrust Commission is highlighted

Partner Gustavo Coelho and associate Fernando Naegele participated in the contribution submitted by the Antitrust Law Commission of the Rio de Janeiro State Bar Association (“CDCOR”) in the Call for Contributions for the economic and competition regulation of digital platforms conducted by the Ministry of Finance. Gustavo and Fernando are, respectively, vice-president and member of the Commission.

CDCOR’s contribution was mentioned several times in the systematization report drafted by the Ministry of Finance, citing points raised by the Commission, such as the inadequacy of CADE’s – Brazilian Antitrust Authority – current criteria for evaluating operations involving digital platforms and the need to conduct studies on the role of gatekeepers in relevant markets for services or the sale of goods offered inside the platform.

Additionally, we highlight that some of the suggestions made by CDCOR were accepted and included in the measures proposed by the Ministry of Finance in the final report, such as the implementation of cooperation mechanisms with the Brazilian DPA whenever personal data is relevant for the services and the creation of a specialized unit on the subject within CADE.
