Recently, on December 16, the Brazilian National Data Protection Authority (“ANPD” or “Brazilian DPA”) imposed preventive measures against X. Corp, responsible for the X (Twitter) app, suspending the use of data from individuals under 18 years old for the training of generative Artificial Intelligence (“AI”) tools.
The measures were: (i) obligation to modify the company’s Privacy Policy to state that the mentioned processing is not happening; (ii) removal of the phrase “para qualquer finalidade (for any purpose)” from the Terms of Use document; (iii) presenting suggested improvements to the Terms of Use; and (iv) submission of clarifications regarding the application of documents referencing the European Union to the context of Brazilian data subjects.
