Call for Contributions on AI regulation

Yesterday, on November 6, 2024, the Brazilian National Data Protection Authority (“ANPD” or “Brazilian DPA”) launched a Call for Contributions to gather public input on its regulatory project for Artificial Intelligence and Data Protection in the context of the Brazilian General Data Protection Law (“LGPD”). The scope also includes the review of automated decision-making.

The Call for Contributions is accompanied by a technical note issued by the Brazilian DPA and includes 15 questions divided into four topics: (i) principles of the LGPD; (ii) legal grounds; (iii) data subjects’ rights; and (iv) good practices and governance.

Among the topics discussed are questions about the possibility of using legitimate interest and consent for processing personal data in AI systems, as well as the need for documentation and draft of the Data Protection Impact Assessment (“DPIA”) for the development and use of AI systems.

The Call for Contributions will be open until December 05, 2024 and can be accessed through the Participa + Brasil platform, available at this link.
