On May 6, 2024, Ordinance no. 722/2024 (“Ordinance”) was published by the Prize and Betting Office of the Ministry of Finance, establishing technical obligations applicable to sports betting houses. This measure is one of the recent developments in Brazil towards the regulation of sports betting.
One of the main points of the Ordinance is the provision that, as a general rule, data centers of betting houses must be located in Brazil or, exceptionally, in a country with which Brazil has a signed International Legal Cooperation Agreement, provided that additional requirements set out in the Ordinance are met.
In addition, the betting houses’ websites will necessarily use the domain “bet.br”. The Ordinance also allowed the establishment of physical betting terminals by sports betting houses that received the authorization to provide their services by the Ministry of Finance, which has not yet occurred.
The Ordinance established various security and governance requirements that must be observed by sports betting houses, such as: (i) verification of the bettor’s identity when opening the account, through facial recognition and CPF (Individual Taxpayer Number) validation; (ii) storage of information from bettors, as well as from all employees or representatives of the sports betting houses; (iii) registration and access control measures, firewalls, and vulnerability tests; and (iv) backup, recovery, and data security procedures.
