On October 27, 2024, the Brazilian Superior Court of Justice (“STJ”) released a list of case law decided after the entry into force of the Brazilian General Data Protection Law (“LGPD”) involving issues related to personal data protection.
Among the topics analyzed in the list, one of the decisions established the need for the data subject to demonstrate actual harm in the event of a security incident to be entitled to compensation for moral damages.
Additionally, in another case, the STJ ruled that storing data improperly, allowing third parties to use it to defraud data subjects and cause financial harm, constitutes a failure in service provision.
