On November 4, 2024, the Brazilian National Data Protection Authority (“ANPD” or “Brazilian DPA”) initiated a sanctioning administrative procedure against TikTok to investigate possible irregularity in the processing of minors’ personal data mainly due to the absence of age verification mechanisms.
The Brazilian DPA is particularly concerned about a feature called the “feed sem cadastro” (feed without registration), which allows users to access and use TikTok without prior registration, during which various data, such as likes, shares, used hashtags, and device settings, are processed.
In addition to initiating the sanctioning administrative procedure, the ANPD ordered TikTok to deactivate this feature within 10 business days and to submit a compliance plan within 20 business days, outlining the actions that will be implemented to prevent minors from using the platform without registration and age verification.
