On August 30, 2024, the Brazilian National Data Protection Authority (“ANPD” or “Brazilian DPA”) published a decision revoking its Preventive Measure issued previously and allowing Meta to process personal data for the training of its generative AI models.
The Preventive Measure, analyzed in this newsletter, had suspended the processing of personal data by Meta for the purposes of training its AI models and the corresponding changes in the Privacy Policy, highlighting several failures in Meta’s conduct, such as a lack of transparency, legal bases, and specific and clear purposes for processing.
According to the decision, the ANPD accepted the Compliance Plan and the information presented by Meta, in which the group committed to clearly notify users, update public documents with more information, and facilitate the opposition to data processing for AI training purposes.
