Ministry of Finance publishes an Ordinance with rules for online gaming in Brazil

Last week, the Ministry of Finance published Ordinance n. 1,207, on July 29, 2024 (“Ordinance”), establishing rules for online betting games in Brazil that fall under the fixed-odds betting category. The Ordinance aims to include these games within the scope of regulation being developed for fixed-odds betting, especially sports betting, ensuring greater security and transparency for bettors, players, and the market.

An online game will be considered online as a fixed-odds betting game when its outcome is determined by random factors and all possible winnings for the bettors in case of victory are presented at the time of the bet. Thus, the Ordinance includes crash, blackjack, lottery, line, card, and roulette games, among others, while skill games, fantasy, multiplayer, and P2P betting games are excluded from the regulations.

Additionally, the Ordinance determined that online games and their studios must be certified by certification entities, also establishing the technical, security, and administrative requirements that must be observed for specific types of online games, as well as for the studios authorized to promote such games.
