On May 15, 2024, the National Data Protection Authority (“ANPD” or “Brazilian DPA”) held an online event to discuss relevant points regarding the concept of high risk in personal data processing. The webinar was an initiative by the Authority due to the ongoing development of the Guideline on High-Risk Personal Data Processing, analyzed in this newsletter.
At the event, the ANPD sought to discuss and clarify doubts about the interpretation of the criteria contained in Resolution no. 02/2022 for defining what will be considered as high-risk data processing, especially regarding the large-scale criterion, such as the number of data subjects and the significant impact on the fundamental rights of the data subjects.
Our team is available for further clarification, as well as to advise on the procedures for complying with the regulatory obligations of the LGPD before the Brazilian DPA.
