Brazilian DPA investigates 20 companies for noncompliance with DPO’s obligations

Recently, On December 13, the Brazilian National Data Protection Authority (“ANPD” or “Brazilian DPA”) announced the beginning of a procedure against 20 companies to investigate potential noncompliance with obligations related to the Data Protection Officer.

These companies, operating in various sectors such as telecommunications, retail, social media, aviation, and food services, allegedly failed to provide an effective communication channel with the Data Protection Officer or had a channel that was ineffective in allowing proper communication with the data subjects and the exercise of their rights.

If irregularities are confirmed and are not addressed by the companies, they may face administrative sanctioning procedures and be subject to the administrative sanctions established in the LGPD.
